A slip and fall case in Essex County, NJ Superior Court recently settled for $725,000. The plaintiff claimed that she stepped into a large pothole in the parking lot of the corporate park where she worked in Livingston, NJ. Plaintiff sustained a back injury that required surgery, and experienced nagging pain in her lower extremities which later caused her to slip and fall at home and fracture her ankle. Plaintiff’s expert opined that the pothole in the parking lot had been there for at least two years. The sole defendant in the case, the company responsible for the management of the corporate campus, claimed that the pothole was open and obvious and that plaintiff’s conditions were congenital. The case settled after pre-trial mediation.
