On May 2, 2014 a jury in New Brunswick, New Jersey handed down a $3.5 million trial verdict to a carpenter who was severely injured after falling from a scaffold. The accident happened when a wheel of the five-foot high scaffold the carpenter was working on became caught in a hole in the floor and tipped over with carpenter on it. He sustained broken ribs, a rotator cuff tear, a herniated disk, collapsed lungs and other injuries requiring surgery and precluding him from returning to work. Defendants in the case included the general contractor, the site construction manager and a sub-contractor. The plaintiff will recover only $2.75 million pursuant to a pre-trial high-low agreement between the parties.
