A plaintiff who fell from a scaffold while performing repairs to a church damaged by Hurricane Sandy recently received $1.5 million to settle his claims. The plaintiff was standing on scaffolding while painting the ceiling of the First Baptist Church of Asbury Park when the plank he was standing on broke free, causing him to fall approximately 15 feet onto a church pew. Plaintiff sustained multiple rib fractures, a collapsed lung, a broken right heel which required surgery and aggravated preexisting herniated discs in his back. Because the accident occurred in the course of plaintiff’s employment, plaintiff received workers’ compensation benefits and a lien attached to a portion of the settlement proceeds in his personal injury action.
