The estate of a Hazlet, NJ man who died after sustaining multiple injuries in a motor vehicle accident recently settled its wrongful death lawsuit for $2.5 million. The decedent was a pedestrian walking in the parking lot of a strip mall when he was hit by a commercial pickup truck. He was pinned beneath one of the truck’s tires and sustained massive trauma to his chest and internal organs. During rehabilitation, the decedent developed an infection that caused organ failure and death. Among the claims asserted by the decedent’s estate were claims for wrongful death and survivorship. Wrongful death claims allow the estate of a deceased individual to pursue compensation for the economic damages caused by the wrongful death. Survivorship claims allow the estate to pursue compensation for the conscious pain and suffering experienced but the decedent after the accident, but prior to death. In this case, the parties agreed to a settlement after pre-trial mediation.
