An injured plaintiff was recently awarded $2.75 million in a slip and fall lawsuit in Essex County Superior Court. The injury occurred when the plaintiff was walking with her daughter on West Main Street in Bogota, NJ and her foot became stuck in a hole in the ground caused by a missing brick paver. The dangerous condition was located on a sidewalk adjacent to a commercial property and had allegedly existed there for three years prior to the accident. As a result of the injury, the plaintiff sustained two herniated discs, underwent chiropractic treatment, epidural injections, an unsuccessful discectomy and a spinal fusion. She now must wear a back brace at all times and has limited strength and range of motion. After a week and a half trial, the jury awarded $575,000 in medical expenses and $2.175 million in pain and suffering.
